Important consumer information about mortgage brokers in Spain
In Spain, mortgage intermediation and mortgage advisory activities are regulated under Ley 5/2019 (LCCI) — the law regulating real estate credit contracts.
Who is covered by this regulation
Individuals or companies that perform any of the following activities may be required to hold the appropriate registration or authorization with Banco de España or the relevant competent authority:
- present or offer mortgage contracts,
- recommend specific mortgage products,
- advise on mortgage agreements,
- negotiate mortgage terms,
- or act as mortgage intermediaries.
Law firms and advisors
This may also apply to professionals such as law firms or advisors if their activities go beyond legal assistance and enter regulated mortgage intermediation or mortgage advisory services.
What consumers should verify
Consumers are encouraged to verify that any mortgage broker, intermediary, or mortgage advisor they work with is properly registered and authorized to provide such services in Spain. Ask the firm directly for their registration details and confirm them with Banco de España or the relevant competent authority before signing any engagement letter, paying any fee, or sharing sensitive financial documentation.
